Abstract

This article examines the impact of regional and international frameworks on the effectiveness of Alternative Dispute Resolution (ADR) mechanisms in resolving disputes within Tanzania's mining sector. It explores the alignment of Tanzania's legal and institutional structures with regional instruments such as the East African Community (EAC) Treaty and the Southern African Development Community (SADC) Protocol on Finance and Investment, as well as international conventions like the International Centre for Settlement of Investment Disputes (ICSID) Convention and the United Nations Commission on International Trade Law (UNCITRAL) Arbitration Rules. The study identifies challenges in harmonizing these frameworks with national laws and practices, assesses their influence on dispute resolution processes, and provides recommendations for enhancing ADR effectiveness in the sector.
