Abstract

In the era of immense technological advancements and the utilization of Artificial Intelligence in the employment sector, data privacy is at stake and needs to be urgently addressed. This study focuses on how deploying various technologies have become pervasive in the work environment. Nevertheless, it addresses how inadequate the existing legal framework is when it comes to addressing the use of advanced technology in the workplace. The study employed a desktop review methodology by synthesizing insights from academia literature relevant to Kenya’s context. The findings concluded that even though the incorporation of technology into the workforce yields inordinate benefits, and improves organizational performance, it poses a huge conundrum of breaching data privacy. This study therefore, serves as a clarion call to the relevant stakeholders to establish a comprehensive legal framework to regulate the ethical use of technology.
